1. Agreement to Terms
These Terms of Use (“Terms”) constitute a legally binding agreement made between you (“you,” “user”) and Damian Witkowski – SugarFree (“Company,” “we,” “us,” or “our”) concerning your access to and use of the SugarFree – AI Macro Tracker mobile application and related services (collectively, the “Services”). By accessing or using the Services, you agree that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use the Services.
2. Our Services
The app provides tools to track nutrition and lifestyle metrics, including macros (protein, carbohydrates, fat), calories, and sugar intake, along with optional insights powered by AI. The Services are provided for informational and lifestyle purposes only and do not constitute medical advice, diagnosis, or treatment.
3. Eligibility
You must be at least 16 years old (or the minimum age required in your country) to use the Services. If you are under 18, you must have permission from a parent or guardian.
4. Accounts and Authentication
You may sign in using “Sign in with Apple” and/or Google Sign-In. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You agree to provide accurate information and to notify us promptly of any unauthorized use.
5. Health Data (Apple Health)
With your explicit permission, the app may read and/or write certain Apple Health data to provide features such as charts and progress tracking, including: (a) reading and writing your weight data; and (b) reading your step count. Health data is used solely to enable in-app features and insights, is not sold, and is not shared with advertisers or analytics providers. You may revoke access at any time in the Apple Health app under “Sources.”
6. User Representations
By using the Services, you represent and warrant that all information you submit is true, accurate, and complete; you have legal capacity and you agree to comply with these Terms; and your use of the Services will not violate any applicable law or regulation.
7. Prohibited Activities
You agree not to: (a) circumvent, disable, or interfere with security features; (b) engage in unauthorized framing or linking; (c) trick, defraud, or mislead other users; (d) upload or transmit viruses, malware, or other destructive code; (e) interfere with or disrupt the Services or networks; (f) use automated scripts to collect information or interact with the Services; (g) reverse engineer, decompile, or disassemble any part of the Services except as permitted by law; (h) harass, abuse, or harm another person; or (i) use the Services for any unlawful or unauthorized purpose.
8. Intellectual Property Rights
Unless otherwise indicated, the Services, including their content, source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics (collectively, the “Content”) and the trademarks, service marks, and logos contained therein (the “Marks”) are owned or licensed by Damian Witkowski – SugarFree and are protected by intellectual property laws. No part of the Services or Content may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose without our express prior written permission.
9. User-Generated Content
If the Services allow you to submit or post content (“User Content”), you retain ownership of such content but grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, modify, and display the content solely for the purpose of operating and improving the Services.
10. Purchases, Subscriptions, and Payment
Premium features may be offered via in-app purchases and subscriptions processed by Apple’s App Store. Prices, billing cycles, and renewal terms are presented in the app. Cancellations and refunds are handled by Apple under its policies. Access to premium features will cease at the end of the paid term if not renewed.
11. Free Trials & Promotions
We may offer free trials or promotional pricing from time to time. If you do not cancel before the trial ends, you may be charged the applicable subscription price.
12. Third-Party Services
The Services may contain links to third-party websites, services, or content (including Apple, Google, Supabase, RevenueCat, analytics, or other providers). We are not responsible for third-party content or practices. Your use of third-party services is at your own risk and subject to their terms and policies.
13. App Management
We reserve the right, but not the obligation, to: (a) monitor the Services for violations of these Terms; (b) take appropriate legal action against anyone who violates the law or these Terms; (c) refuse, restrict access to, limit the availability of, or disable (to the extent technologically feasible) any of your submissions or any portion thereof; and (d) manage the Services in a manner designed to protect our rights and property and to facilitate the proper functioning of the Services.
14. Modifications and Interruptions
We reserve the right to change, modify, or remove the contents of the Services at any time or for any reason in our sole discretion without notice. We also reserve the right to modify or discontinue all or part of the Services without notice at any time. We will not be liable to you or any third party for any modification, price change, suspension, or discontinuance of the Services.
15. Governing Law
These Terms are governed by the laws of Germany and applicable laws of the European Union, without regard to conflict of laws principles. Mandatory consumer protection rights of your country of residence within the EU remain unaffected.
16. Dispute Resolution
If a dispute arises, please contact us first at damian.witko@gmail.com to attempt informal resolution. If we cannot resolve the dispute, you agree to submit to the exclusive jurisdiction of the courts located in Germany, unless mandatory law provides otherwise.
17. Disclaimer
THE SERVICES ARE PROVIDED ON AN “AS-IS” AND “AS-AVAILABLE” BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
18. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR REVENUES, ARISING FROM YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS RELATING TO THE SERVICES WILL NOT EXCEED THE AMOUNT YOU PAID (IF ANY) FOR ACCESSING THE SERVICES IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
19. Indemnification
You agree to defend, indemnify, and hold harmless Damian Witkowski – SugarFree, its affiliates, and their respective officers, agents, partners, and employees from and against any loss, damage, liability, claim, or demand arising out of your use of the Services or violation of these Terms.
20. User Data
We will maintain certain data that you transmit to the Services for the purpose of managing performance and providing the Services. You are solely responsible for all data that you transmit or that relates to any activity you have undertaken using the Services.
21. Electronic Communications, Transactions, and Signatures
Visiting the Services, sending us emails, and completing online forms constitute electronic communications. You consent to receive electronic communications, and you agree that all agreements, notices, disclosures, and other communications we provide to you electronically satisfy any legal requirement that such communication be in writing.
22. Severability
If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of any remaining provisions.
